Arvind Kejriwal v. CBI
On Tuesday, the Delhi High Court issued a notice to CM Arvind Kejriwal appealing his arrest. The National Bureau of Investigation’s (CBI) three-day remand in a corruption case involving an alleged liquor policy fraud.
Justice Neena Bansal Krishna demanded the probe agency’s answer and scheduled a hearing for July 17.
Kejriwal has asked for his immediate release in the corruption case. It is the situation that, although the offence is punished by 7 years. The Investigating officer failed to comply with the requirements of Section 41A and 60A CrPC notice. As a result, his arrest fails to meet the legal standards.
Senior Advocates Abhishek Manu Singhvi and N Hariharan, together with Advocate Vivek Jain, represented Kejriwal. Special attorney DP Singh appeared for the CBI.
Singhvi said that no urgency or requirement exists for arrest in the matter because the CBI arrested Kejriwal in August 2022. He added that authorities only asked for his interrogation once in April last year, during which he cooperated.
He went on to tell the court that the arrest document provided by the CBI did not meet the legal requirements.
Kejriwal is in judicial detention on charges of corruption and money laundering in connection with the alleged scheme.
On June 26, vacation judge Amitabh Rawat remanded the Chief Minister to CBI custody for three days, saying that the detention was not unlawful at this time.
However, the judge said that while the arrest was not unlawful, the CBI should not be overzealous.
On June 29, vacation judge Sunena Sharma remanded Kejriwal to judicial prison, since the CBI did not request additional remand at this time.

Last week, the probe agency interviewed the Chief Minister at Tihar prison. Where he remains in judicial custody in connection with a money laundering case under investigation by the Enforcement Directorate (ED).
Kejriwal’s comments were recorded. This came only hours after the Delhi High Court delayed the Chief Minister’s bail in the PMLA issue.
On June 26, with the court’s consent, the CBI interrogated Kejriwal in court and formally arrested him in the case.
The Enforcement Directorate (ED) detained Kejriwal on March 21. In May, the Supreme Court granted him temporary release until June 1 due to the upcoming general elections. He surrendered on June 2.
